The Service is designed for general wellness, education, tracking, and habit support. It is not a medical device. ## 2. Eligibility You must be at least 16 years old, or the minimum age required in your country if higher, to use the Service. If you are under the age of majority where you live, you may use the Service only with permission from a parent or legal guardian who agrees to these Terms. You may not use the Service if you are legally prohibited from doing so or if we have previously suspended or terminated your account for violating these Terms. ## 3. No Medical Advice Bright Workout does not provide medical advice, diagnosis, treatment, emergency services, or clinical monitoring. Fitness, nutrition, sleep, readiness, body-composition, heart-health, and mental-wellness information in the Service is for general informational and coaching purposes only. You are responsible for deciding whether the Service is appropriate for you. Consult a qualified healthcare professional before starting or changing exercise, nutrition, hydration, sleep, weight-loss, weight-gain, supplement, or wellness routines, especially if you have a medical condition, injury, disability, pregnancy, history of disordered eating, or other health concern. If you may be experiencing a medical emergency, or if you may harm yourself or others, contact local emergency services or crisis support immediately. Do not rely on Bright Workout for emergency or crisis response. ## 4. Fitness and Wellness Risks Physical activity involves risk, including injury, illness, overexertion, or other harm. You agree to use judgment, follow proper technique, use appropriate equipment, warm up, stop if you feel pain or unsafe symptoms, and seek professional guidance when needed. Any exercise demonstrations, workout plans, calorie estimates, recovery suggestions, readiness indicators, or wellness prompts are general guidance and may not fit your individual circumstances. ## 5. Nutrition, Food, and Body Metrics Nutrition values, food database entries, barcode results, AI food estimates, portion estimates, calorie targets, macro targets, hydration goals, BMI, body-fat estimates, and weight projections may be incomplete, inaccurate, or based on assumptions. Food labels, recipes, restaurant portions, user-contributed databases, and serving sizes can vary. Do not rely on the Service to manage allergies, medical diets, diabetes, eating disorders, pregnancy nutrition, medication interactions, fluid restrictions, or any condition requiring professional care. Always verify food ingredients, allergens, labels, and nutrition information independently. ## 6. AI Features Some features use artificial intelligence or automated systems to generate or analyze content, including food image analysis, manual food estimates, recipes, coaching tips, and workout programs. AI outputs may be wrong, incomplete, unsafe, biased, or unsuitable for your body, goals, equipment, diet, or health status. You are responsible for reviewing AI outputs before relying on them. We may modify, limit, or discontinue AI features at any time. ## 7. Accounts and Security You may need an account to use parts of the Service. You agree to provide accurate information and keep your login credentials secure. You are responsible for activity under your account. The Service may support email login, Apple Sign In, Google Sign-In, and password reset flows. If you believe your account has been compromised, contact us at support@brightworkout.com. ## 8. Your Content and Data Inputs "User Content" means content or information you submit, upload, log, record, scan, import, or otherwise provide to the Service, such as profile details, body metrics, food logs, workout logs, custom exercises, photos, voice inputs, journal entries, goals, preferences, and feedback. You keep ownership of your User Content. You grant Bright Workout a worldwide, non-exclusive, royalty-free license to host, store, process, analyze, transmit, display, and use your User Content as needed to provide, maintain, secure, improve, and support the Service. You represent that you have the rights needed to provide your User Content and that it does not violate law, privacy rights, intellectual property rights, or these Terms. ## 9. Health Integrations and Device Permissions If you connect Apple Health, HealthKit, Health Connect, Google Fit through Health Connect, or another device or health-data source, you authorize the Service to access the data types you approve through your device settings. This may include activity, steps, distance, sleep, workouts, calories, heart-rate metrics, HRV, resting heart rate, and VO2 max. Where available and enabled, Bright Workout may also write workout-related data back to a health platform. You can revoke health permissions through your device settings. Health platform data may be delayed, incomplete, duplicated, estimated, or unavailable. Bright Workout is not responsible for errors from third-party devices, platforms, or sensors. The app may request device permissions such as camera, microphone, speech recognition, photos, notifications, and background audio. Some features will not work without the relevant permission. ## 10. Third-Party Services and Data Sources The Service may depend on third-party services, platforms, software, AI providers, analytics tools, authentication providers, app stores, health platforms, food databases, and cloud infrastructure. These may include Apple, Google, Supabase, PostHog, OpenAI-compatible AI providers, USDA FoodData Central, Open Food Facts, and other services used to operate the app. Third-party services are governed by their own terms and policies. We are not responsible for third-party services, data, outages, errors, or content. ## 11. Privacy Our Privacy Policy explains how we collect, use, share, and protect information. Acceptable Use You agree not to: - use the Service for unlawful, harmful, fraudulent, abusive, or misleading purposes; - attempt to access another user's account or data; - interfere with, disrupt, scrape, reverse engineer, overload, or compromise the Service; - upload malware, harmful code, or content that violates another person's rights; - submit images, audio, text, or other content you do not have permission to use; - use the Service to provide medical, clinical, emergency, or regulated professional services without proper authorization; - misuse AI features, health integrations, or food databases; - bypass usage limits, security controls, or payment restrictions. ## 13. Paid Features Some features may be free, and some may require payment, subscription, trial, or in-app purchase. If paid features are offered, pricing, renewal terms, cancellation options, and trial details will be shown before purchase. Purchases made through Apple App Store or Google Play are processed by the relevant app store and are subject to that store's payment, refund, cancellation, and subscription rules. We do not control app-store billing decisions. You are responsible for managing or canceling subscriptions through the platform where you purchased them. We may change pricing, feature availability, trial offers, or paid plans prospectively as permitted by law. ## 14. Intellectual Property The Service, including the app, software, design, logos, trademarks, text, graphics, audio, videos, workouts, exercises, templates, and other content, is owned by Bright Workout or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial wellness and fitness tracking. You may not copy, sell, sublicense, distribute, modify, create derivative works from, or exploit the Service except as expressly allowed by these Terms or applicable law. ## 15. Feedback If you send us ideas, suggestions, bug reports, or other feedback, you grant us the right to use that feedback without restriction or compensation to you. ## 16. Account Deletion and Termination You may delete your account in the app settings. Account deletion is intended to permanently delete your account and associated app data, subject to limited retention where required or permitted by law, security, fraud prevention, dispute resolution, backups, or legitimate business operations. We may suspend or terminate your access to the Service if you violate these Terms, create risk for us or others, use the Service unlawfully, or if we discontinue the Service. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnity, governing law, and dispute provisions. ## 17. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability. We do not guarantee health, fitness, nutrition, sleep, mood, weight, body-composition, performance, or wellness outcomes. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you. ## 19. Limitation of Liability To the fullest extent permitted by law, Bright Workout and its owners, employees, contractors, affiliates, service providers, and licensors will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, personal injury, health outcomes, device failures, or service interruptions arising from or related to your use of the Service. To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of: (a) the amount you paid to us for the Service in the 12 months before the claim, or (b) USD $100. Nothing in these Terms limits liability that cannot legally be limited. ## 20. App Store Terms If you download the Service from the Apple App Store, you acknowledge that these Terms are between you and Bright Workout, not Apple. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you. If you download the Service from Google Play or another app store, your use of the Service may also be subject to that store's terms, policies, and usage rules. ## 22. Export and Sanctions You may not use, export, or re-export the Service in violation of applicable export control, sanctions, or embargo laws. You represent that you are not located in a country or region subject to a U.S. government embargo or designated as supporting terrorism, and that you are not listed on any prohibited or restricted party list. ## 23.
